General Regulations

  • As per Town Code §48-9 – No person, firm or corporation shall commence the erection, construction, enlargement, alteration, removal, improvement, demolition, conversion or change in the nature of the occupancy of any building or structure or cause the same to be done without first obtaining a separate building permit from the Department of Building and Fire Prevention for each such building or structure, except that no building permit shall be required for the performance of ordinary repairs which are not structural in nature.

  • Fire Code Permits
  • All businesses in Henrietta must apply for and maintain required Fire Code Permits in order to be compliant with Town Code regulations. Each business must have either a current Use & Occupancy (renewed every three years) permit or a Public Assembly Permit (i.e. restaurants, theaters, meeting and event spaces, etc.) (renewed every year). Any business with a Commercial Fire Alarm also requires a permit (every two years).

  • Building Permits
  • Building Permits are required for equipment modifications and/or swap outs on existing Telecommunications towers. A Building Permit Application, structural analysis, and stamped drawings are required. Co-locations require Planning Board approval, which is handled through the Engineering Department prior to submission of a Building Permit.

  • Driveway Paving/Re-Sealing
  • Residents re-paving or re-sealing their driveways must obtain a Driveway Permit from the Town of Henrietta Highway Department. If the dimensions of the driveway are being altered, a variance may be required. Any resident thinking of altering the dimensions of their driveway should contact the Town of Henrietta Highway Department to determine if a variance is required.   • Sewer Repair/Replacement
  • Sewer Repair/Replacement permits are issued through the Building Department. A current Henrietta Plumber’s License and appropriate insurance coverage is required for contractors performing the repair or replacement. A follow-up inspection must be conducted by the Sewer/Drainage Department. For additional information and necessary applications, please contact the Building and Fire Prevention Department.

  • Signs
  • All signs in the Town of Henrietta require a Sign Permit that is renewable every five years. The regulations regarding signage can be found here. Applications can be found on the Town’s website here.
  •  
  • Pre-existing/Non-conforming
  • Properties that are pre-existing, non-conforming can continue in their current use unless there is a vacancy period of 12-months or more, in which case the allowed use will revert to the base zoning of the property.

  • Rental Properties
  • Residential Rental Properties must have a Rental Registry Certificate. The fee for Rental Registration is $150 per three-year periods. No more than three unrelated parties may inhabit a rental property. The application can be found here and approval is dependent upon review by the Code Enforcement Officer.
