Variances
  • Variances – Variances are issued from the Zoning Board of Appeals (ZBA) for the purpose of waiving a requirement of the zoning code. For more information on the ZBA, please click here. There are two different types of variances – Use Variance and Area Variance.

  • Area Variance – An Area Variance is an exception that would allow someone to use a parcel of land in a manner which is not allowed by the dimensional or physical requirements of the applicable zoning regulations. For example, a homeowner would like to construct a larger shed on their property than Code allows; they can apply to the Zoning Board to allow for the larger size.   • Use Variance – A Use Variance is an exception that would allow someone to use a parcel of land in a way that would otherwise be restricted due to the Zoning District applied to said parcel. For example, a property owner would like to convert an existing single-family home into a multifamily home in an R-1 Residential District. Since multifamily residences are not allowed in an R-1 Residential District, one could apply to the Zoning Board of Appeals for a use variance as long as they can satisfy four specific criteria.
